Justice Gregory Fitch presided over some of the case management hearings for some of my appeals in the BC Court of Appeal (244069-2-KC, 244069-6-B, 244069-7-B).
Although my experiences with most of the BC judges has been marred by their corruption and misconduct, this has not been the case with Justice Fitch. I have not identified any particular misconduct on his part. I would say, though, that I strongly disagree with some of his rulings. For example, there was a section 684 application I had in July 2021, wherein my argument was, essentially, that at North Fraser Pretrial Centre and Fraser Regional Correctional Centre (where I was being detained), I had absolutely no access to case law or other legal research material to prepare and argue my appeals. I provided case law showing that in such circumstances it is appropriate to appoint a lawyer to assist the unrepresented, in-custody appellant R. v. Terezakis, 2010 BCCA 260. However, in his Reasons for Judgment, Fitch made no mention of Terezakis, relying instead on R. v. Parchment, 2011 BCCA 174, which the prosecution had relied on, even though it was not analogous to my circumstances.
