Exhibit list from index offense; BCSC file no. 33414-W [Patrick Fox; Daniel Mulligan (BCPS)]

Dear Mr. Mulligan:

At my 525 hearing on 2022-09-29 you appeared for the Crown. In your submissions you reiterated the Crown's incessant but false claim that I was born in Canada, not in the US; and that I am a Canadian citizen, not a US citizen. I pointed out that my US birth certificate had been filed as an exhibit in the trial n the index offense - the criminal harassment trial before Justice Holmes (BCSC no 27178), and that the US birth certificate proves I was born in the US, and that if I was born in the US then I am a US citizen. You then sternly insisted that my claim that my birth certificate was an exhibit in the criminal harassment trial was a "bald faced lie". And if my memory is correct, you then went on to say that there is no way Justice Holmes would have made the findings she had if my US birth certificate had been accepted as an exhibit at that trial. I then pointed out the criminal harassment trial occurred in the same court house the 525 hearing was occurring in and, therefore, both you and Justice Wedge had immediate and unlimited access to those exhibits and could very easily verify whether I am telling the truth. I then pointed out that over the past six years the Crown has accused me, many times, of lying but that in every instance I have always been able to prove, with actual, physical evidence that I was, in fact, telling the truth and that it was the Crown who was lying.

When Justice Wedge read her Reasons for Judgment she was very hostile toward me and adamantly insisted I am NOT a US citizen. However, she made no mention of my birth certificate or whether or not it had been filed as an exhibit in the trial before Justice Holmes.

The next day, 2022-09-30, I sent a letter to the BCSC Registry, requesting a copy of the Exhibit List from the trial and sentencing in the index offense. On 2022-10-28 I received the exhibit list. Unfortunately, I am not able to obtain photocopies here at NFPC, but I'm quite certain you have unlimited access to it from your computer.

Now, if you turn your attention to the section entitled "Exhibits on Trial Proper - 12 June 2017", you will notice Exhibit Number 2, submitted by the prosecution, which has the following Description:

3 page document; first page is Bureau of Vital Statistics Certificate of Birth State File Number: 109-1973-088300 for Patrick Fox; Date of Birth: November 24, 1973; …

And again, I point out that it was submitted by the Crown, Mark Myhre, NOT by me.

So there you have it, Mr. Mulligan, once again the Crown is wrong and I am right! You were lying, not me! And I must assume Justice Wedge checked the exhibit list over the lunch break and even though she knew I was telling the truth she falsely insisted I was lying.

And, if you look at the end of the Exhibit List you will see an item marked as Exhibit 1 in the probation variance application before Justice Holmes on 2019-02-06. The Descriptions references a "previous Canadian passport". However, if you look at the document in question you will see that it is actually an Emergency Travel Document (ETD) - NOT a passport! It was issued to ICE to deport me from the US to Canada; regardless of the fact that I am not a Canadian citizen.
