Dear Mr. Rankin:
I noticed the article posted to the CBC website on 2021-04-12, regarding my sentencing, was not credited to any particular reporter. If you are not the appropriate party for me to address in this matter then I ask that you please forward this letter to whoever is the appropriate party. Thanks.
I was recently talking to a friend and I told her of the recent sentence and probation order which, literally, just contains a few of the exact same conditions as Justice Holmes imposed back in 2017 relating to the website and publishing information about Capuano (you know, those conditions I've been completely ignoring for the past 2 years) and which are still in effect anyway. My friend laughed and said “So? What have they [the BCPS] accomplished? Nothing! The website is still online and it's going to stay online. As long as it stays online they just look like a bunch of fools.” She is absolutely right.
And let me point out, the new probation order only contains a subset of the conditions that were already imposed in the 2017 order which is still in effect anyway, so the new order is completely pointless – it's redundant. It is the most pathetic attempt the BCPS could have made to save face after what I had said in my previous letters to you and David Eby. Sure, you can argue that the new order will remain in effect past the expiration of the 2017 order (which expires in December 2021), however, unlike the 2017 order, the new order doesn't require me to report or to remain in BC/Canada so the moment I leave Canada (presumably, the later of 2021-12-30 or my release from custody) it will be completely unenforceable – again, completely pointless and meaningless. I even pointed out to the judge, that I intended to leave Canada at the earliest opportunity so any probation order would be unenforceable and pointless.
And now take a moment and consider how much time and money the BC government has spent investigating, prosecuting, and incarcerating me over these past five years … and in the end they've accomplished absolutely nothing – the website is still online … just as I said right from the beginning that it would be.
Interesting that none of this was mentioned in your article. I guess I'll just have to make sure a copy of this letter ends up on the website with a link to your article.
