Your 2020-09-10 article "BC man facing new charges over revenge website targeting ex-wife" [Patrick Fox; Eric Rankin (CBC News)]

Dear Mr. Rankin:

On 2020-09-19 you posted an article about me refusing to take down the desicapuano.com website and new criminal charges based on that refusal.

First, I would like to point out you erroneously claim:

The site falsely accuses his former spouse, Desiree Capuano, of being a white supremacist, a drug addict and a child abuser …

But, in fact, Capuano admitted each of those accusations was actually true, in her testimony during the criminal harassment trial in 2017. It's all in the transcripts and audio recordings from the trial, which are all on the website. If it's not clear to you exactly where, I would be happy to point it out for you. So, your statement that the site “falsely accuses” Capuano is incorrect. Also, I have consistently pointed out, in court, that not a single statement on the website has ever been found to be false and I have repeatedly demanded Crown Counsel (Mark Myhre, Bernie Wolfe, Chris Johnson) point out a single, specific statement on the website which is false – and they have consistently failed or refused to do so. I have also invited every single person who has ever been to the website to try to find a single false claim about Capuano on the website (see the footer of every page of the website) and not a single person has found a single false statement.

For that reason, I respectfully insist you amend your article accordingly.

Now, I would like to point out that regardless of the new changes, regardless of the fact I have been in custody since 2020-09-17 and intend to remain in custody until February 2022, the website remains online, and not a single change has been made to it as a result of the BCPS's or the BC government's (or the Canadian news media's) actions against me. As I've said, locking me up changes nothing! The Canadian and BC governments (and the Canadian news media) are powerless, they are completely impotent in this respect! There is absolutely nothing they can do to cause the website to cease to be publicly accessible because, as they know and as you know, there is absolutely nothing illegal about the website – not under Canadian law nor US law. And at the end of the day, all they're doing is very publicly proving how completely powerless, vindictive, and petty they are in this matter.

In addition, Crown Counsel Chris Johnson, recently stated in court that the Crown's only seeking a sentence, not another probation order. Which means the Crown will no longer be seeking to try to force me to take down the website. Which means they acknowledge they are powerless to make me take it down. And, it means they acknowledge they do not believe Capuano is actually being harmed by the website – because if they did believe she was being harmed by it they would have an obligation to do everything they can to cause that harm to stop. And if they do not believe Capuano is being harmed by the website then they cannot believe I was guilty of criminal harassment! So now I ALSO have that additional evidence that they knew I was not guilty of criminal harassment but they prosecuted me and sent me to prison for it anyway. Also, this proves that the Crown knows that Justice Heather Holmes' 2017 Reasons for Sentence is just completely full of crap – all the scathing vitriol that Holmes spewed about me and all the false praise and pity she showered on Capuano – because, again, if any of what Holmes said in her Reasons for Sentence had any truth to it then the BCPS would HAVE TO prosecute me for criminal harassment based on the current website. I pointed out all of this to David Eby in a letter I sent him n 2021-02-28 (which will, of course, be published on the website).

I'd also like to point out, that on 2021-02-02, Johnson admitted, in open court (so it's in the DARS and cannot be denied) that the real reason I am in jail and being prosecuted on these current charges is because I continue to publish proof of the corruption that has been occurring in my cases, on the parts of the BCPS and the judges – NOT because of any perceived harm to Capuano. I also covered that in a letter to David Eby, dated 2021-02-03.

And, on 2021-02-02, the judge in the current case adamantly and baldly lied, on the record, in open court (so again, it's in the DARS), about having ordered the transcripts of the trial! He insisted he had not done so and was not going to do so and that if I wanted them I would have to appeal. The thing is, the judge himself had stated at the end of the trial that he was going to order the transcripts and a copy would be provided to me, and I have already confirmed with JC WordAssist, that the transcripts HAD been ordered by, AND provided to the court! I have it in writing from JC WordAssist. This was also covered in the 2021-02-03 letter to Eby. Now why do you suppose a Provincial Court judge would lie, on the record, about an official matter like that?

And you even have a quote from that hack lawyer, David Georgetti, claiming this has been a “precedent-setting case” and “it demonstrates that the criminal justice system is taking internet harassment seriously”. Really? If the criminal justice system is taking internet harassment seriously, and if the website constitutes “internet harassment” then why is it that since March 2019 (over two years now) the criminal justice system adamantly refuses to prosecute me for criminal harassment based on the new/current website? I keep demanding that they do so! I keep openly admitting (both in court and on the website itself) that I am the one that put the website online and made it publicly accessible and that if it constituted criminal harassment in 2016-2017, such that I could be convicted and sentenced to three years in prison for it then it must still be criminal harassment today. And that if the website does constitute harassment, and if there was no corruption, misconduct, or perjury at my 2017 trial then I've given the BCPS way more than enough evidence to guarantee a conviction, so there'd be absolutely no reason to not prosecute me. Right? And even after I very publicly pointed that out in the Dear David Eby” post on the website, the BCPS still adamantly refuses to prosecuted me for criminal harassment. How can this be? Because it's NOT harassment!!! Not criminal harassment; not Internet harassment; not any type of harassment at all!!! David Georgetti is just a sad, pathetic loser who will say anything to try to save face and to get his name in the news. He's a big man when he's talking to the news media, yet he's afraid to take my phone calls and he refuses to respond to my letters – even though he's supposedly suing me.

And if Georgetti is not completely full of crap then why is it that he has essentially abandoned the civil suit he filed against me, supposedly on behalf of Capuano, back in August 2017? I've repeatedly encouraged him to move forward with the case, to take it to trial, but he firmly refuses. He has, literally, not done a single thing to move that case forward. Because he knows that everything I say on the website is completely true – all the claims about Capuano, and all the claims of corruption and misconduct in the justice system. He knows that at a trial, I would confront Capuano with the proof of all the perjury she committed at the 2017 trial (proof which is publicly accessible, right on the website). If Georgetti believes a single word of what he's been saying in the news media then why is he not trying to have me found in contempt for violating the temporary injunction he obtained requiring me to take down the website? Because he's full of shit and he knows it.

And why is it you Canadian “news media” people keep reporting what pathetic hacks like Georgetti (and Johnson and Myhre) say about me but you never give me an opportunity to respond to their claims? Why is it you'll report his obviously false, unsupported claims but you make absolutely no mention of the fact that for more than three years he has been refusing to move the case forward or to proceed with the trial? Do you believe your audience is so stupid they will hear the one side of the story you present them and they will accept that is the full story? Of course, you and I both know your audience IS that stupid. If they had any ability to think for themselves they would realize the website is still online; they'd go to the website so they can see for themselves – rather than relying solely on what you, a third party, are telling them; and, they'd immediately realize that you, and CBC (and almost all of the Canadian “news media”), are deliberately misrepresenting the facts and, thereby, lying to them. And no intelligent, self-respecting person would continue to pay attention to someone that chronically lies to them. Therefore, it is safe an reasonable to assume that anybody who listens to the Canadian news media is stupid and has no self-respect.

I suppose I can understand why Georgetti says such ridiculous things to the news media. He's trying to save face because I have consistently made him look like a fool. He though that if he got a temporary injunction against me then I'd be intimidated and take the website down and he'd negotiate a settlement from a position of power, and he'd have a quick, easy victory. But it just didn't work out that way and now he looks like a completely useless tool, a twit, a loser. He has failed miserably and hasn't accomplished a single thing for his “client” - and to make matters much worse, I've created a “profile section” about him on the website that is going to highlight his incredible failures. And whenever someone Googles his name it will be at the top of the search results, just like when you Google “Mark Myhre”.

And consider that not only does the BCPS refuse to prosecute me for criminal harassment, they also refuse to deny ANY of my allegations of corruption, misconduct, collusion, or perjury – to date not a single person from the BCPS or the Ministry of Attorney General or the Ministry of Justice has stated, or even suggested, that my claims are not true. Though I find it decidedly curious that the Canadian news media steadfastly refuses to even ask anyone in the justice system about my claims of corruption, misconduct, collusion, and perjury.

But of course, I expect neither you, nor CBC, nor any other Canadian news media is going to mention any of this. So, thank God things like the desicapuano.com website exists so a copy of this letter can be published therein.
