Dear Mr. Fraser:
Further to my previous emails, I am forwarding you a copy of the final affidavit in support of my ineffective assistance claims against Lagemaat, and my collusion and complicity claims against Lagemaat and Myhre.
I am also forwarding you a copy of documentation I have from IRCC and CBSA which clearly shows they acknowledge I was not born in Canada and have not status in Canada.
You will notice on the third page of the IRCC record, they did a manual override (a Non Computer Based Entry) to issue a 10 year authorization for me to enter and remain in Canada (which expired in May 2018). What's interesting about that is that they clearly knew at the time they issued it that I had obtained the Canadian passport based on false pretenses and that I wasn't a Canadian citizen. They made no attempt, at all, to verify I was the person named on the passport - even while I was informing them I lied on the application. You will also notice that authorization to enter/remain in Canada was issued almost immediately after the US ICE charged me with perjury and false claim of US citizenship.
The other document I'm forwarding, from IRCC, contains the applications for emergency travel documents filled out by me when ICE was trying to deport me to Canada in 2011 and 2013. What's interesting in that document is that either ICE or the Canadian Consulate changed the information I provided, without my knowledge or consent, AFTER I had completed and signed the application, in order to get the travel documents issued. To be clear, yes, I am saying either ICE or the Canadian Consulate forged legal documents in order to get a travel document issued so they could deport someone who is not a Canadian citizen to Canada.
Due to my current circumstances - having no legal status in Canada but being prohibited under my probation conditions from leaving - my probation officer (Brandon [Cowan]) suggested I apply for social assistance. I did so, even though I realize illegal aliens do not qualify for social assistance. The case manager, Tamara, at the Ministry of Social Development, said they'd need to verify my status with IRCC before they could proceed. She called me this morning to inform me that IRCC says I definitely do not have status in Canada and based on that it is unlikely I will qualify for assistance, however the application has not been officially denied yet.
I had a psych assessment last week, as required by my probation order. The doctor, Dr. Levy, said my beliefs (about not being a Canadian citizen) are clearly supported by evidence so I'm not delusional and he doesn't see a need for any further meetings. So, unfortunately for the Crown, it seems I'm actually perfectly sane.
There is a case management conference about the appeal/ineffective assistance claims on February 1, 2019. I was supposed to have a hearing on January 23, to remove the probation condition requiring me to remain in BC, but the Crown (Susanne Elliott) claimed she thought I was only asking to change my restrictions on using the internet, so the hearing has been continued until who knows when.
My 30 days at the Belkin House homeless shelter expired this morning so, as of today, I am officially a street person. But at least the Canadian government is finally acknowledging I am not authorized to be here. Now, if only they'd deport me or let me leave...
