Synopsis
This is BC Supreme Court Justice Heather Holmes' Reasons for Sentence in the criminal harassment case against me.
As you read this you might be thinking: What the hell did this guy do, keep his ex-wife locked up in a closet in the basement for six years or something? No! I created a website to expose my ex-wife for the horrible lying, manipulating sociopath that she is; and I engaged in strongly worded arguments with her, by email - arguments which she invariably initiated, and she even admitted in her testimony that she was deliberately trying to provoke me and to keep me engaging with her TR 2017-06-14 p50l35-p51l4 ... and that's all. It can't be emphasized too much that in almost every instance she was the one that started with the belligerence and insults and I was always merely responding to her very deliberate provocation.
Holmes Is A Delusional, Compulsive Liar
You may also notice, there is a huge amount of commentary in this document. That is because Justice Heather Holmes is a compulsive liar who lives in an insane, delusional fantasy land, where the justice system is infallable and the justice system participants (e.g. judges, lawyers, and police) are, by the very laws of nature and physics, incapable of engaging in impropriety. For example, when I tried to present proof that Lagemaat and Myhre knew Capuano committed extensive perjury at the trial, Holmes became hostile and insisted Myhre had conducted himself honorably and with integrity throughout these proceedings.
Holmes also has an incredible ability to ignore and deny the existence of evidence which is not consistent with the ruling she wants to make. For example, in her Victim Impact Statement, Desiree came right out and clearly stated that she did not believe that I would actually go to Arizona Victim Impact Statement (that is significant because her supposed fear for her safety was based on her claimed belief that I would go to Arizona and murder her). When I pointed this out to Holmes, at the sentencing, she responded that that's not what it says. Dude! It's right fucking there, in Desiree's own words, clear as day.
At the trial and sentencing, the prosecutor made it seem as though I was the one being belligerent, insulting and hostile, and that Desiree was just a poor, helpless, beat down victim who had done nothing to warrant my brutal attacks against her. As you can see here, the judge completely bought into that - even though at the sentencing I provided, literally, hundreds of emails from Desiree to me, proving she was consistently the one starting the insults, and deliberately trying to provoke me.
And for exposing an evil sociopath, I was sentenced to three years and ten months in prison, plus three years of probation Probation Order, which:
- required me to report, in person, twice a week;
- prohibited me from leaving the province of British Columbia;
- required me to remove the website and anything else I had previously published about Desiree, from public accessibility;
- prohibited me from disseminating or distributing any information about Desiree - the literally means I was even prohibited from verbally uttering her name or referring to "my ex-wife", in the presence of other people;
- prohibted me from using the internet (except for employment or receiving emails);
- and a bunch of other stuff that's not worth mentioning here.

Count 1: Criminal Harassment between January 2015 and May 2016
The goal of this website is to increase awareness of Desiree Capuano, by informing the public of the atrocious, the despicable, and the downright evil things Desiree has done.
We hope that by publishing the truth, together with hard proof (e.g. police reports, court testimony, recordings) of the countless horrendous acts Desiree has been committing all her life, we may help others to avoid being manipulated, exploited and harmed by this seemingly charming and sweet sociopath.
I know that the best way to hurt you, permanently, is emotionally, not through your reputation, finances, or career (remember I told you many months ago that that other stuff I was doing was just to distract you?). And what could be more effective than for your child to utterly despise you because of your own actions?
In another email around that time, Mr. Fox casually told Ms. Capuano that he had acquired her medical records, "(unofficially of course)". Then, in an email in November 2015, he threatened future action of several types:Desiree:
As a show of good faith, I'll fill you in on one of the plans that I'm working on for you. What I'd like, very much, is to be able to add some "intimate" pictures of you to your web site. To do that, of course, I'd have to hire someone to get close to you, pretend to be interested in you. Eventually, gain your trust, then eventually sleep with you. That should take...what? About 3, 4 days? Difficult to find people that unscrupulous. But for the right price there's always someone willing to do what you want. Hooray America! There's nothing criminally illegal about it. You may be able to pursue a claim in civil court, but I'm not going to worry about that.

I was pretty direct when I told Detective Tuchfarber that my intention was to do everything in my power and capabilities to make your life as miserable as possible, and, if possible, to the point that you ultimately commit suicide. That would be my ultimate desire. But before you reach that point it is imperative that you experience as much misery, disappointment, and suffering as possible first. At this point in your life you have very little to lose so there is not much incentive for me to actively publish your information. I shall wait, patiently, until you rise up a bit, THEN proceed with the billboard campaign around Phoenix; I'll wait until you actually have some financial significance, THEN publish your complete credit and financial history - including your social security number and birth certificate (not illegal as long as it's done outside the US).
He [G] once asked me if I would shoot you. I told him that murder is illegal and immoral and can result in spending the rest of one's life in prison. And that the rest of my life in prison is not a risk I'm willing to take. But otherwise, no, I would have no qualms about it; that that is how much I despise you for the things you've done and continue to do. ... To be clear, I told Tuchfarber the same thing. There is nothing illegal or threatening about /wanting/ to harm someone - as long as you don't act on it. I am reasonable and rational enough to know the difference, and to refrain from engaging in such activity. And let me be absolutely clear on this point: I would never deliberately cause you physical harm, other than in self defense or defense of another. Though that is nothing special toward you - I have that rule for *ALL* people. Also, I emphasize that G brought up the question and I only responded to it truthfully.There can be no doubt that these communications were meant to intimidate Ms. Capuano, despite the caveat Mr. Fox always included about remaining within the confines of the law.

The Crown submits that other case authorities indicate that the applicable range of sentence for the criminal harassment is between one and four years' imprisonment. I point out to Holmes that if I have no citizenship or immigration status in Canada, then it is illegal for me to remain in Canada. So, if I remain in Canada I am breaking the law, which means I am violating Condition 1. But if I leave Canada, I will be violating Condition 9. But as you see from her lack of response, she simply didn't care. You see? Two plus two equals five.
